5.1 Registration & Confirmation
Submission of an official Invictus Leader registration form constitutes an application to participate and does not confirm or reserve a place.
A participant’s place is confirmed only upon receipt and verification of full payment by Invictus Leader, unless otherwise expressly agreed in writing. Following verification of payment, Invictus Leader will issue a written Confirmation of Participation.
All places are subject to availability. Where capacity is limited, places will be confirmed in the order payment is received and verified. Invictus Leader reserves the right to release any unpaid place after the stated payment deadline without further notice.
Registration becomes binding once payment has been received, verified and participation confirmed by Invictus Leader.
5.2 Programme Investment & Payment
The applicable programme fee, payment deadline and payment instructions will be stated in the programme brochure, invoice, registration acknowledgement, payment request or other official communication issued by Invictus Leader.
Full payment must be received by the stated deadline unless otherwise agreed in writing. Registrations received after the deadline may be accepted at Invictus Leader’s discretion, subject to availability and immediate payment.
All bank charges, transfer fees, currency conversion charges and other payment-related costs shall be borne by the participant or sponsoring organisation.
5.3 HRD Corp Claims
Where a programme is stated to be HRD Corp claimable, the participating or sponsoring organisation remains responsible for its eligibility, approvals, documentation and submission of claims within the applicable timelines.
HRD Corp claimability does not constitute a guarantee of approval or reimbursement. A pending, delayed or rejected claim does not constitute payment or confirmation of a participant’s place unless otherwise agreed in writing by Invictus Leader.
5.4 Cancellation & Participant Substitution
Unless otherwise expressly agreed in writing, fees paid for confirmed participation are non-refundable.
Where a confirmed participant is unable to attend, a substitute participant from the same organisation may attend at no additional programme fee, subject to applicable programme requirements and written notification at least three (3) working days before the programme.
Any exception, waiver, credit, transfer, refund or alternative arrangement is valid only where expressly agreed in writing by Invictus Leader.
5.5 Programme Changes
Invictus Leader may reasonably amend the programme content, facilitator(s), venue, format, date or schedule.
If the programme is postponed, confirmed participants will be transferred to the rescheduled programme or offered an equivalent alternative. If Invictus Leader cancels the programme and no reasonable alternative is accepted, the programme fee paid will be refunded.
Invictus Leader is not responsible for related travel, accommodation or other consequential costs, except where required by law.
5.6 Photography, Recording & Intellectual Property
Official photographs or recordings may be taken for educational, communication or promotional purposes, subject to applicable consent and personal data requirements.
Participants may not record, reproduce or distribute programme sessions or materials without prior written permission.
All programme materials, frameworks, methodologies, models, tools and related intellectual property remain the property of Invictus Leader Sdn. Bhd. or the respective rights holder and may not be reproduced, taught, distributed, adapted or commercially used without prior written permission.
5.7 Privacy & Personal Data
Personal information collected in connection with registration and participation will be used for legitimate programme administration, participant communication, payment, registration management and programme delivery purposes.
Invictus Leader Sdn. Bhd. will manage personal data in accordance with applicable Malaysian personal data protection requirements, including the Personal Data Protection Act 2010 (PDPA), where applicable.
Participant information will not be used or disclosed for unrelated purposes except where consent has been obtained or disclosure is required or permitted by law.
5.8 Force Majeure & Limitation of Liability
Invictus Leader shall not be liable for delay, postponement or cancellation caused by circumstances beyond its reasonable control and may reschedule, change the delivery format or offer an alternative programme.
To the extent permitted by law, Invictus Leader’s total liability shall not exceed the programme fee paid for the affected participant and excludes indirect or consequential losses.
5.9 Official Communications & Variations
No verbal representation, WhatsApp message or other informal communication shall amend, override or vary these Terms & Conditions unless the variation is expressly confirmed in writing by an authorised representative of Invictus Leader.
5.10 Governing Law & Jurisdiction
These Terms & Conditions are governed by the laws of Malaysia, and any dispute shall be subject to the jurisdiction of the courts of Malaysia.
